- Acceptance of Terms & “As-Is” Provision
By accessing or using this App, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
The App is provided on an “AS IS” and “AS AVAILABLE” basis. The Developer makes no representations or warranties of any kind, express or implied, regarding the operation of the App or the information, content, or materials provided.
The App does not guarantee any specific outcome, result accuracy, statistical distribution, or user satisfaction from any draw, randomization, or feature provided.
- Limitation of Liability
To the fullest extent permitted by applicable law, the Developer shall not be liable for any damages arising out of or related to the use of the App, including but not limited to direct, indirect, incidental, punitive, or consequential damages. This includes, without limitation, loss of profits, loss of data, business interruption, or any other commercial damages or losses, even if the Developer has been advised of the possibility of such damages.
Claims based on dissatisfaction with draw outcomes, perceived unfairness, repetition of results, or misunderstanding of randomization behavior shall not constitute damages under these Terms.
In any event, the Developer’s total cumulative liability shall not exceed the total amount paid by the user for the App or in-app purchases during the twelve (12) months preceding the claim.
- In-App Purchases and Consumable Tokens
Local Storage & Risk of Loss
All digital tokens are consumable goods. Because the App operates without user accounts, tokens are stored locally on the user’s device. Token balance accuracy depends entirely on the integrity of the local device environment and operating system behavior.
No Recovery Guarantee
The Developer has no technical access to the user’s device or local storage and therefore cannot restore, recover, transfer, or refill tokens lost due to app deletion, device changes, operating system updates, hardware failure, or any other reason.
No Transfers
Tokens are tied exclusively to the specific app installation instance and are not transferable between devices, users, or installations.
Refund Policy
All purchases are processed and controlled exclusively by Apple Inc. The Developer has no access to payment systems, transaction authority, or refund mechanisms and cannot override Apple’s decisions under any circumstances. Any billing disputes must be resolved directly through Apple.
- Draw Processing, Fairness & Data Limitations
Draw participant data is limited to what is available to the App at the time of processing, and the Developer assumes no responsibility for missing or incomplete data.
All draw results are generated exclusively through automated, code-based randomization processes. The Developer does not manually select, influence, adjust, or override any outcome.
Visual animations, previews, or representations shown during a draw are illustrative only and do not represent the complete participant pool or internal selection logic.
By using the App, the user accepts all draw results as final and waives any claim alleging unfairness, bias, manipulation, or improper operation.
- Modification and Discontinuance of Service
The Developer reserves the right to modify, update, suspend, or permanently discontinue the App or any feature at any time, with or without notice. The Developer shall not be liable to the user or any third party for any such modification or discontinuance.
- User Indemnification
You agree to indemnify, defend, and hold harmless the Developer from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from your use of the App or violation of these Terms.
- Third-Party Services & No Affiliation
The App may utilize third-party services, including analytics and diagnostics tools. The Developer does not control, operate, or guarantee the availability, accuracy, or behavior of any third-party service.
The App is an independent third-party application and is not affiliated with, endorsed by, or associated with Apple Inc., Meta Platforms, Inc., Instagram, or any of their subsidiaries.
- Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. The courts of Turkey shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App.
